Terms and Conditions of Sale - Galerie Rivière

These Terms and Conditions of Sale (hereinafter "T&Cs") govern the purchase of artworks offered for sale by Galerie Rivière (hereinafter "we", "our", "us") on our website Galerieriviere.com . By placing an order on our site, you agree to these terms and conditions in full.
1. Seller Information

2. Purpose
These T&Cs define the rights and obligations of both parties in the context of online sales of artworks offered by Galerie Rivière on its website. They apply to all orders placed on our site.
3. Products
The artworks available for sale are described on the Galerie Rivière website. The information and photos provided are for illustrative purposes only. While we strive to ensure the accuracy of the descriptions, errors or omissions may occur. If in doubt, please contact us before finalizing your order.
4. Prices
The prices of the artworks are stated in Euros (€) and include VAT (if applicable). Shipping fees are not included in the artwork price unless otherwise stated. Shipping fees will be added to the total order amount at checkout.
Prices are subject to change at any time. However, products are billed at the prices in effect at the time of the order.
5. Order Process
To place an order, the buyer must:
- Select the desired artwork(s) and add them to the shopping cart.
- Complete the order form with their personal information.
- Choose a payment method and confirm the order.
The order will be considered accepted when payment is successfully processed. Galerie Rivière reserves the right to cancel or refuse any order for legitimate reasons, including in the case of a dispute with the buyer, unauthorized payment, or unavailability of the artwork.
6. Payment
Payment for the artworks can be made by credit card (Visa, MasterCard, etc.), PayPal, or any other payment method available on the site at the time of the order. Payments are processed securely through Shopify Payment and PayPal.
The total order amount is charged at the time of confirmation. In the event of a payment failure, the order will be canceled.
7. Shipping
The artworks will be shipped to the address provided by the buyer during the order process. Shipping fees are calculated based on the delivery address and the size/weight of the artwork.
Shipping times vary depending on the selected shipping method and destination. Galerie Rivière cannot be held responsible for delays caused by circumstances beyond our control (e.g., shipping carrier delays, strikes, weather conditions, etc.).
Galerie Rivière is committed to packaging artworks carefully to ensure their protection during transit.
8. Reception and Product Conformity
The buyer must check the condition of the artworks upon receipt. If the buyer notices any non-compliance or damage (visible damage, wrong product, etc.), they must notify us in writing within 48 hours of receiving the package. If the claim is validated, an exchange or refund may be offered, in accordance with our return policy.
9. Right of Withdrawal
In accordance with Article L. 221-18 of the French Consumer Code, the buyer has the right to withdraw from the contract within 14 days of receiving the artwork, without providing any reason or incurring penalties.
To exercise the right of withdrawal, the buyer must notify Galerie Rivière in writing (via email or mail). If the buyer exercises the right of withdrawal, they must return the artworks in their original condition, unused, and undamaged. Return shipping costs are the buyer's responsibility.
In case of withdrawal, Galerie Rivière will refund the full amount of the order, including standard delivery costs, within 14 days of receiving the returned artworks.
10. Warranty
Our artworks are guaranteed against manufacturing defects. In case of defects or anomalies, you may contact us to request a repair, replacement, or refund. The warranty does not cover damages caused by misuse, improper care, or unauthorized modifications to the artwork.
11. Liability
Galerie Rivière cannot be held responsible for indirect damages (such as loss of data, profits, or business opportunities) arising from the purchase of an artwork. Our liability is limited to the total amount of the order.
12. Intellectual Property
The artworks displayed on our site are protected by copyright and intellectual property laws. Any reproduction, representation, or distribution of these artworks without the prior written consent of Galerie Rivière is prohibited.
13. Protection of Personal Data
The personal information collected during your order is necessary to process and deliver your order. In accordance with the General Data Protection Regulation (GDPR), you have the right to access, rectify, and delete your personal data. For more information, please refer to our Privacy Policy.
14. Modification of T&Cs
Galerie Rivière reserves the right to modify these Terms and Conditions at any time. Any updates will be posted on this page, and the "Last Updated" date at the top of this page will be revised accordingly.
15. Governing Law and Jurisdiction
These T&Cs are governed by French law. In case of a dispute, French courts will have jurisdiction, unless otherwise provided by mandatory law. If you are a consumer residing in the European Union, you may also use the Online Dispute Resolution platform provided by the European Commission: https://ec.europa.eu/consumers/odr
